VERDICT ALERT: Hillsborough County, FL– Another defense verdict for Shelton | McKean! The Plaintiff, a surgical tech, was a customer at Sam’s Club when he sat down in a chair, causing it to break. The Plaintiff went to the emergency room immediately for injuries to his low back. Ultimately, the Plaintiff underwent treatment including physical therapy, injections, and a 2-level spine surgery with medical bills in excess of $100,000.00. The Plaintiff also stopped working a six figure job and claimed past and future lost wages. The defense pointed out that the Plaintiff exceeded the weight limit warning that was clearly visible to the customers. The Plaintiff claimed that the chair was broken before he sat down in it. The Jury returned a complete defense verdict in less than 10 minutes! With another expired proposal for settlement, Plaintiff may be facing judgment for defense fees and costs.
